Club fight man drank 'a week's alcohol in one night'

A BOTTLE-WIELDING drunk who was involved in a nightclub scuffle after downing litres of alcohol on a night out has been handed 40 hours of unpaid work as part of a six-month community order.

Darryl Wayne, 20, of Cumbria Court in Farnborough, was sentenced at Guildford Crown Court last Friday (January 6).

Wayne admitted using threatening, abusive or insulting words or behaviour with intent to cause fear of or provoke violence at an earlier hearing.

During a court appearance on January 3, prosecutor Jill Beale said the offence had taken place on June 7 last year, when Wayne went to the Dusk nightclub in North Street, Guildford, after visiting "a number of other places".

She said: “[He] had been consuming a large amount of alcohol – Mr Wayne said he had drunk five bottles of wine and one bottle of vodka and some cocktails and estimated his drunkenness as being eight out of 10.

“There was an argument in the nightclub and Mr Wayne picked up a bottle from the bar and hid it in his trouser pocket – another group seemed to be intent on confronting them.

“Mr Wayne responded by turning round with the bottle in his hand, then there was a scuffle and both defendants were ejected from the club.

“On CCTV he can be seen with the bottle in his hand, holding it up in the air.

“He said the group looked threatening and because of that he took the bottle out, but said he had not swung it at anybody, but agrees he held it up.”

Mrs Beale added Wayne had been in “a lot of trouble” in the past for matters including an incident involving an imitation firearm, criminal damage, theft of vehicles, shoplifting and possession of class B drugs.

Heather Stevens, defending Wayne, said: “I should say [my client] does say [that] since the incident he has not been drinking.”

Recorder Jeremy Carter-Manning said: “This is clearly heavily alcohol-related, with an alcohol background and it seems to me like he had more than one week’s alcohol that evening.”

Wayne was also ordered to pay £40 costs, which he offered to repay at £2 per week.

A fellow defendant, Shaun Common, 19, of Brookhouse Road, Farnborough. who pleaded guilty on November 29 to inflicting grievous bodily harm on June 7, will be sentenced for his offence on January 20.

Why is alcohol consumption considered to be an excuse for violence? People choose how much they have to drink, and therefore are completely responsible for their actions. Any punishment should echo this. £2 per week for somebody who can afford 5 bottles of wine and a bottle of vodka in one night is utterly pathetic.

Five bottles of wine , a bottle of vodka and 'cocktails' . Only 8 out 10 ? I'm impressed ...I'm falling over after 2 bottles of wine and a Sambuca.

What's always frustrating about such fines is that it equates to less that one week's car parking charges for someone parking in the centre of Guildford to go to a 9-5 job. I'm sure that most people facing those parking charges do not have enough spare budget to afford 5 bottles of wine and a bottle of vodka a week - it is also disturbing to think of this as "more than one week's alcohol" - more like more than a month's if you consider the NHS guidelines.
